Welcome to Rock’s Cool Ltd. (“we”, “us”, or “our”). By accessing or using our website and services, you agree to comply with and be bound by these Terms of Service (“Terms”). Please read these Terms carefully before using our services.

1. Updates to These Terms

2. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

Violate any applicable law or regulation in the UK.

Engage in any activity that could damage, disable, or impair the services or website, including uploading malicious code or engaging in fraudulent activities.

Use our services to harass, defame, or infringe upon the rights of others.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these Terms.

3. About Us and Our Service

3.1. Rock’s Cool provides a subscription-based music education service for children aged 4 to 11. Lessons typically take place during the school day, though occasionally they may be scheduled before or after school hours. You’ll be notified of any such instances at the time of enrolment.

3.2. If you register before the academic school year begins, we aim to deliver no fewer than 35 lessons, or 32 lessons plus 3 end-of-term performances by the end of the academic year (known as “Full Year’s Programme”).

3.3. For those joining part-way through a school year, a proportional number of lessons will be scheduled using a calculation based on the remaining available lessons for that year compared to a full year’s programme.

3.4.If external factors (e.g., school closures, pupil absences, illness isolations, school trips etc) delay service delivery, we’re not liable for missed sessions. We will try to reschedule where possible if enough advance warning is given by you or the school. Sessions missed due to staff absence will not count towards your service quota.

3.5. Each student will be assigned one instrument per lesson cycle to support consistent learning. If a change of instrument is desired, please contact us at contact@rocks-cool.co.uk — we’ll accommodate the request where possible, subject to availability.

3.6. We provide instruments and equipment for lessons. If your child wishes to bring their own instrument, it is done so at your own risk and we cannot accept liability for damage or loss unless due to our staff’s negligence.

3.7. Students may have the opportunity in the future to work towards a qualification accredited by a recognised awarding body. For further details, please contact contact@rocks-cool.co.uk.

3.8. All teaching staff undergo regular safeguarding training and maintain up-to-date DBS checks.

4. Summary of Your Agreement

When you sign up with Rock’s Cool:

  • We only confirm your enrolment after reviewing your request.

  • We may refuse enrolment requests under certain circumstances.

  • The agreement continues until either you or we decide to end it.

  • You can cancel your subscription (details below).

  • We aren’t responsible for delays caused by events beyond our control.

  • Payments are made upon sign-up and then monthly on the first of every calendar month (excluding August).

  • We may charge interest on overdue payments.

  • VAT increases may be passed on to you.

  • You’re responsible for ensuring your details are accurate.

  • Additional charges may apply if required information isn’t provided.

  • You have a 14-day right to change your mind.

  • You have rights if something goes wrong.

  • We may adjust services or these terms, giving notice where appropriate.

  • Services may be suspended or withdrawn.

  • We limit our liability for losses in specific situations.

  • We process your personal data in accordance with our Privacy Policy.

  • Dispute resolution options are available.

  • Other important legal terms apply.

5. Acceptance of Your Application

We’ll confirm acceptance of your enrolment once we provide your service.

6. Right to Refuse

We may reject applications, for example due to credit issues, location outside our service area, or pricing errors. If this happens, we’ll inform you and issue a refund for any amounts paid.

7. Contract Duration

This agreement remains active until cancelled by you (see section 8) or by us (see sections 18–19).

8. How to Cancel

You may cancel by emailing us at contact@rocks-cool.co.uk stating that you would like to cancel your subscription.

  • Cancellations processed by the 20th of the month take effect immediately and you won’t be charged for the following month.

  • If submitted after the 20th, cancellation occurs at the end of the following month.

  • Services already paid for will continue until the end of the paid period.

9. Payments

Payment Processing: All payments for subscriptions are processed by GoCardless, a third-party payment provider. By subscribing to our services, you authorize GoCardless to charge your payment method for monthly subscription fees. Please refer to their Privacy Policy for more information on how payment information is processed.

Payments are taken monthly by direct debit on the 1st for that months lessons.

  • The payment cycle runs for 11 months (no charge in August).

  • If joining mid-month, your first payment will cover a pro-rata amount for the partial month and the following full month by direct debit (coming out on the 1st).

  • All fees will be made clear during sign-up.

If your child finishes their final school year, we’ll automatically cancel payments at the end of the academic year.

Billing: Subscription fees are billed monthly regardless of how many lessons take place in that month (some will be more than others). Payments will be automatically charged on the same day of each month as per your subscription date.

Cancellation: You may cancel your subscription at any time by sending us an email at contact@rocks-cool.co.uk Cancellations will take effect at the end of the current billing cycle. After cancellation, you will not be charged for subsequent months.

Refunds: All payments are non-refundable, except where required by law. If you cancel your subscription, you will continue to have access to the service until the end of the current billing period, but no future charges will be applied.

10. Interest on Late Payments

We may charge interest on overdue payments at 4% per annum above the Bank of England’s base rate, accruing daily until settled.

11. VAT Adjustments

If VAT rates change between signing up and service delivery, we’ll adjust your charges unless you’ve already paid in full.

12. Responsibility for Your Details

You are responsible for providing accurate, up-to-date information when requested.

13. Additional Charges for Missing Information

We reserve the right to charge additional fees if missing information impacts our ability to deliver services effectively.

14. Consumer Rights (UK)

As a UK consumer, you have certain statutory rights under UK law. You have the right to cancel your subscription within 14 days of signing up for the service, provided no services (such as lessons) have been provided yet. After 14 days or after receiving lessons, your right to cancel is subject to our normal cancellation terms.

15. If Something Goes Wrong

Please contact our team at contact@rocks-cool.co.uk if you experience issues. We’ll work to resolve any problems promptly.

16. Service and Terms Updates

We may update these Terms from time to time. Any changes will be posted on our website, and the revised Terms will take effect as of the date indicated at the top of the document. By continuing to use our services after the revised Terms are posted, you agree to be bound by the updated Terms. We may make minor changes to comply with legal requirements or technical needs without affecting your use. For significant changes, we’ll notify you, and you may cancel before changes take effect.

17. Service Suspension

We may temporarily suspend services for technical, legal, or operational reasons. You’ll be notified, and if suspension exceeds 60 days in a 12-month period, we’ll adjust fees accordingly.

18. Service Withdrawal

We may stop offering services with at least 21 days’ notice and will refund any prepaid, undelivered services.

19. Ending the Contract

We may end your contract for non-payment or failure to provide necessary information after giving reasonable notice.

We may suspend or terminate your access to our services if you violate these Terms, if we believe your actions are harmful to the operation of our services, or if we are required to do so by law. You may also terminate your account at any time by contacting us.

Upon termination of your account, you will no longer have access to our services, but you will remain responsible for any outstanding payments for the current billing cycle.

20. Limitation of Liability

We’re not responsible for losses:

  • That were unforeseeable

  • Caused by factors beyond our control

  • You could have reasonably avoided

  • Connected to business use

To the fullest extent permitted by law, Rock’s Cool Ltd. will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability to you will not exceed the total amount you have paid to us in the past six months.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence or for any liability that cannot be excluded by law.

21. Indemnification

You agree to indemnify and hold harmless Rock’s Cool Ltd., its employees, affiliates, and partners from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of our services or your breach of these Terms.

22. Privacy and Data Protection

Your use of our services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. We comply with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR). For more details on how we handle your data, please review our Privacy Policy.

23. Dispute Resolution

If you have a complaint, contact us at contact@rocks-cool.co.uk. Disputes can also be resolved through the courts in your jurisdiction.

24. Other Legal Terms

  • We may transfer this agreement to another provider.

  • You can only transfer your agreement with our consent.

  • No one else has rights under this agreement.

  • If a court invalidates part of this agreement, the rest remains in effect.

  • Delay in enforcing our rights does not mean we waive them.

25. Intellectual Property

All content on our website, including text, images, videos, logos, and software, is the property of Rock’s Cool Ltd. and is protected by copyright and trademark laws. You may not use, reproduce, or distribute any content from our website without our prior written consent.

26. Governing Law

These Terms will be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
